Terms of Use

These Terms of Use ("Terms") govern your use of the Lotify app provided by Irena Kynaly ("we", "us"). By using Lotify you agree to these Terms.

1. What Lotify does

Lotify helps you evaluate products and create marketplace listings, and — when you connect an eBay account — publish listings to that account. AI-generated estimates (price, demand, descriptions) are guidance, not guarantees.

2. Your account and eBay connection

You are responsible for your account and for any activity under it. When you connect eBay, you authorize Lotify to create listings on your behalf using the access you grant. You remain responsible for your listings and for complying with eBay's policies and applicable law.

3. Acceptable use

You agree not to use Lotify to list prohibited, illegal, counterfeit, or infringing items, to upload content you don't have rights to, or to misuse the service. You are responsible for the accuracy of your listings and for any photos or content you provide.

Lotify may suggest product photos from eBay or the open web as candidates. These are shown for your review only. You are solely responsible for confirming that a suggested image matches your exact item and that you have the right to use it; do not include any image you are not authorized to use.

4. Subscriptions and billing

• Lotify offers Free, Plus, and Pro plans with monthly usage limits.
• Paid subscriptions are sold as auto-renewable subscriptions through the Apple App Store. Payment is charged to your Apple ID, and subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You manage or cancel subscriptions in your Apple ID settings. Refunds are handled by Apple under their terms.
• Prices and plan limits may change; we will give notice of material changes.

5. AI and third-party services

Product identification and text generation are powered by third-party AI (Anthropic). Listing and account features rely on eBay. We are not responsible for the availability or decisions of these services.

6. Disclaimers

Lotify is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. Estimates and generated content may be inaccurate; review everything before publishing.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits or sales, arising from your use of Lotify.

8. Termination

You may stop using Lotify at any time. We may suspend or terminate access for violations of these Terms or misuse of the service.

9. Governing law

These Terms are governed by the laws of Tennessee, United States, without regard to conflict-of-laws rules.
